IRC §1400Z was designed to encourage private investment in low-income communities. By investing gain from the sale or exchange of any property to an unrelated party in a Qualified Opportunity Fund, a taxpayer can defer the tax on the gain. This tax-deferral is reminiscent of the tax-deferral currently permitted for the like-kind exchange of real estate, but IRC §1400Z takes the tax benefits a couple of steps further.
Depending on the holding period for the investment in a Qualified Opportunity Fund, a portion of the deferred gain that will eventually be realized can be eliminated, and the appreciation of the investment from the date of purchase will not be taxed when the investment is sold.
